Content/s refers to messages, data, information, texts and other material including that of advertising nature.
For the purposes of this contract shall apply:
a) travel organizer: the person who undertakes in his own name and lump-sum payment, to provide packages to third parties, realizing the combination of the elements listed in the following article. 4 or offering the tourist, even through a system of distance communication, the ability to independently carry out and purchase such a combination;
b) intermediary: the subject who, not professionally and non-profit, sells or agrees to procure rare-packages conducted in accordance with the following art. 4 to a lump-sum payment;
c) tourist: the purchaser, the transferee of a package tour or any person to be appointed even if it meets all the conditions required for the use of the service, on whose behalf the principal contractor agrees to purchase without a remuneration package.
2. RELATION BETWEEN Storiaviva Viaggi AND THE USER
In accessing, surfing or in any way using the website, the user agrees the terms and conditions of use and other dispositions and directives that the terms and conditions of use refer to as well as to any of their subsequent modifications. Where the user does not agree to be bound by the above, including any subsequent modifications, he/she must not access, surf or in any way use the website.Storiaviva viaggi reserves the right to integrate or modify at its own discretion any of the dispositions contained in the terms and conditions of use including any disposition and/or directive that the website refers to.
3. LEGISLATIVE SOURCES
The sale of tourist packages which have as their object services to be provided in both national and international territory, is covered – until it is repealed pursuant to art. 3 of Legislative Decree no. 79 of 23 May 2011 (the “Code of Tourism”) – by Law 27/12/1977 n ° 1084, ratification and implementation of the International Convention on Travel Contracts (CCV) signed in Brussels on 23.4.1970 – in applicable – and the Tourism Code (Articles 32-51) and its subsequent amendments.
4. ADMINISTRATIVE ARRANGEMENTS
The organizer and the broker of the package, where the tourist will appeal must be enabled execution of their activities in accordance with applicable administrative regulations, including regional. Pursuant to art. 18, paragraph VI of the Code Rd., Use the company name or title of the words “travel”, “travel agency”, “tour operator”, “travel broker” or other words and phrases, including in a foreign language, of a similar nature, is allowed only to qualified companies referred to in the first paragraph.
6. CONCEPT OF THE TOUR PACKAGE
The concept of the tour package is the following: “The packages are subject to travel, vacation, the” all-inclusive “cruise tourism, resulting from the combination, and in any way by anyone realized, of at least two of the following when sold or offered for sale at an inclusive price: a) transport b) accommodation c) tourist services not ancillary to transport or accommodation in art. 36 that constitute the satisfaction of the recreational needs of the tourist, significant part of the “package” (Art. 34 Cod Rd.). The tourist is entitled to receive a copy of the contract for the package (prepared in accordance with the procedures laid down in Article. Cod 35 Rd.). The contract is eligible for entry into the Guarantee Fund referred to in art. 21.
7. THE TOURIST INFORMATION – TECHNICAL
The organizer draws up a catalog or brochure program – including on electronic medium or electronically – a sheet. The mandatory elements of the technical catalog or brochure program are:
The administrative authorization or, if applicable , the DIA or S.C.I.A. organizer;
Details of the insurance of civil liability;
Period of validity of the catalog or brochure program;
Terms and conditions for the replacement of the traveler (Art. 39 Cod Rd.);
Parameters and criteria for the adaptation of the holiday price (Art. 40 Cod Rd.);
The organizer also insert in the data sheet any further particular conditions.
8. RESERVATIONS
Reservations are accepted until all available seats . The reservation request must be made on the appropriate form , completed in full and signed by the customer. Acceptance of bookings is subject to availability of seats and it is complete, with subsequent conclusion of the contract, only upon written confirmation by the Organiser. Indications regarding the package not contained in the contractual documents, brochures or other means of communication will be provided by the Organiser to the consumer, in fulfillment of its obligations under the load from the DL 111/95 in good time before the start of the trip.
9. PAYMENTS
Upon booking you will be paid a deposit equal to 25 % of the price including the entire registration fee , where required , while the balance will be done at least 30 days prior to departure, provided that the reservation has been confirmed pursuant to art. 6 . For reservations at any time subsequent to the above date , the full amount must be paid at the time of booking only solution.
10. PRICE
The price of the package is determined in the contract, with reference to what is stated in the catalog or program out of print and to any change of the catalogs or catalog programs out subsequently intervened . It can be changed up to 20 days prior to departure and only as a result of changes in:
Transportation costs , including the cost of fuel;
Dues, taxes on certain types of tourist services such as taxes, fees or landing fees , landing or co – yaw at ports and airports;
The exchange rates applied to the package in question.
For these variations reference will be made to the exchange rate and costs mentioned above in effect on the date of publication of the program, as stated in the data sheet of the catalog , or the date of any updated namenti above.
The fluctuations affect the fixed price of the package in the percentage expressly indicated in the technical catalog or brochure program.
11. MODIFICATION OR CANCELLATION OF A TOURIST PACKAGE BEFORE DEPARTURE
Before the departure the organizer or intermediary that needs to significantly change one or more elements of the contract , it shall immediately notify in writing to the tourist , indicating the type of change and the variation of the price that goes with it .
If you do not accept the proposed amendment referred to in paragraph 1 , the tourist may exercise the right to recover the sum already paid or to offer an alternative tourist package in accordance with the 2nd and 3rd paragraph of Article 10 . Tourists can exercise the above rights also when cancellation is due to failure to achieve the minimum number of participants indicated in the catalog or in the program out of print or in cases of force may- kings and fortuitous events, related to the tourist package purchased . For cancellations other than those caused by force majeure, accident and failure to reach the minimum number of participants , as well as for those other than the lack of acceptance by the visitor of the alternative tourist package offered , the organizer canceling, ( Article 33 letter . Cod and Cons. ) will return to the tourist double -ple of what was paid and collected by the organizer through the travel agent. The amount to be refunded will not exceed double the amount of which the tourist would be on the same date the debtor in accordance with art . 10 , paragraph 4 if he had to cancel.
12. WITHDRAWAL OF TOURIST
The tourist can withdraw from the contract without penalty in the following cases:
Increase in the price referred to in art . 8 in excess of 10 % ;
Significant modification of one or more elements of the contract as fundamental to the enjoyment of the package as a whole and proposed by the organizer after the conclusion of the contract but prior to departure and not accepted by the tourist. In the cases mentioned above , the tourist has the right either : – make use of an alternative tourist package , at no extra cost or with the restit dell’ecceden ck -ing money, if the second package has a value lower than the first – the refund of the money already corrisposta.Tale refund must be made within seven working days from the receipt of the redemption request . Catalo -go technique or program out of print or customized trip , any proceeds of insurance cover requested at the time of conclusion of the contract or for other services already rendered.
The tourist must give notice of its decision (to accept the change or withdraw) not later than two working days from the time when he received the notice of increase or change . In the absence of express notice within such period , the proposal made by the organizer will be considered accepted .
The tourist who withdraws from the contract before departure outside those listed in the first paragraph, or in the case provided by art. 7 , paragraph 2 , will be charged – regardless of the payment of art. 7 paragraph 1 – the cost of the individual practice , the penalty in the amount indicated in the In the case of groups such payments will be agreed from time to time upon signing the contract.
13. CHANGES AFTER DEPARTURE
The organizer , if after the departure is unable to provide for any reason except for the fact its a tourist , an essential part of the services included in the contract , will provide alternative solutions , without additional cost to the contractor and if the services provided are of less value than those provided , refund an amount equal to such difference . If it is not no alternative solution , namely the solution of the operator is refused by the tourist for proven and justified reasons, the organizer will provide at no extra cost , a means of transport equivalent to that originally planned to return to the starting point or any other agreed place , depending on the availability of resources and people, and will reimburse the extent of the difference between the cost of benefits provided and the services performed up to the time of the return -to anticipate.
14. REPLACEMENTS
The tourist may be substituted by another person provided that:
a) The organizer is informed in writing at least 4 working days before the date fixed for the departure , receiving information about the reasons for the replacement of the transferee and b ) the transferee satisfies all the conditions for the use of the service ( art. Cod 39 Rd. ) and in particular the requirements for passports , visas , health certificates;
c) the same services or other substitute services can be provided as a result of the substitution ;
d) The substitute reimburse the operator any extra costs incurred to replace , to the extent that will be quantified prior to the sale.
The transferor and the transferee are jointly and severally liable for the payment of the balance due and the amounts referred to in subparagraph d) of this Article.
Any additional terms and conditions for substitution are indicated in the data sheet.
15. OBLIGATIONS OF TOURISTS
The tourist will inform the organizer in writing , at the time of booking, special requests for personal – that may be the subject of specific agreements , provided that it is possible to implement.
The tourist is obliged to inform the Intermediary and the organizer of any of its requirements or special conditions ( pregnancy, food allergies , disabilities , etc …) and to explicitly specify the demand for personalized services.
16 . LIABILITY REGIME
The organizer is liable for damages caused to the tourist due to total or partial of the benefits in the contract, whether these are performed by him or by third party service providers , unless he proves that the event was caused made by tourists ( including initiatives undertaken by the latter in the course of the tourist services ) or by the fact of a third party in an unforeseeable or unavoidable circumstances beyond the provision of services under the contract , as the case unforeseeable circumstances , force majeure or circumstances that the organizer could not , according to the professional diligence reasonably foresee or resolve.
The intermediary with whom the booking has been made of the tour package is not liable in any way for the obligations arising from the organization of the trip, but is responsible exclusively of the obligations arising from his role as intermediary and , in any case , within the limits provided for this responsibility by the rules in force, unless the exemption provided for in art. 46 Cod Rd.
17. LIMITS OF COMPENSATION
The compensation referred to in Articles . 44, 45 and 47 of the Code Rd. and relevant statute of limitations , as provided herein shall be governed by and in any case within the limits established by the CCV . International Conventions governing the performance which are covered by the package and Articles 1783 and 1784 of the Civil Code.
18. OBLIGATION TO SUPPORT
The organizer is obliged to lend assistance to the tourist according to the professional standard of care with exclusive reference to the obligations at its own expense required by law or contract. The organizer and the intermediary are exempted from their responsibilities (Articles 15 and 16 out of these Conditions General ), when the failure or improper performance of the contract is attributable to the tourist or is dependent on a third party to unforeseeable or unavoidable, or was caused by a fortuitous event or force majeure.
19. COMPLAINTS AND REPORTS
Any failure in the contract must be contested by tourist during the use of the pack- through timely submission of the complaint so that the organizer , his local representative or guide can remedy the situation promptly . Otherwise, the damages will be diminished by the or excluded pursuant to art. 1227 cc. The tourist must – on pain of forfeiture – a complaint by sending a registered letter with start to – know of receipt, or other means that guarantees proof of receipt to the organizer or intermediary, no later than ten working days from the date of return to the place of beginning.
20. INSURANCE COSTS OF CANCELLATION AND RETURN
If not expressly included in the price , it is possible, and advisable, to enter upon pre – notation at the offices of the organizer or intermediary special insurance policies expenses deriving from of the package, possible accidents and events relating to baggage transported . It will also be possible to enter into a service contract that covers repatriation costs in case of accidents, illness , incidentals and / or force majeure . The tourist will exercise rights under these contracts exclusively against Insurance Companies stipulating the conditions and in the manner provided by these policies.
21. ALTERNATIVE DISPUTE RESOLUTION OF
In accordance with the purposes of Art . 67 Cod Rd. the organizer may propose to the tourist – in the catalog, on the site or in other forms – alternative methods of resolution of disputes have arisen. In this case the organizer will indicate the type of alternative resolution proposed and the effects that such membership.
22. GUARANTEE FUND (Art. 51 Cod Rd.)
The National Guarantee Fund established for the protection of the tourists who are in possession of the contract, shall provide the following requirements in the event of insolvency or bankruptcy of the intermediary or the organizer said: a) return of the price paid.
23. PRODUCT VALIDITY, MODIFICATIONS & AMENDMENTS
Products offered by Storiaviva viaggi as displayed at www.romeintour.com are valid till December 2014. Storiaviva viaggi is not responsible for any information that it does not directly provide.
ADDENDUM
GENERAL TERMS AND CONDITIONS OF SALE OF SINGLE TOURIST SERVICES
A) REGULATORY PROVISIONS
The contracts for the supply of the only transport service , the only service of accommodation or qua – lunque other separate tourist service can not be configured as a case in point of travel or tourist package , are governed by the following provisions CCV art . 1 , no. 3 and n . 6 , Arts. 17 to 23 , Arts. 24 to 31 (limited to the portions of those provisions that do not relate to the organization contract ) and other agreements concerning the sale of a single service contract . The seller undertakes to procure that third parties, including electronically, a tourist service to breakdown , is required to issue the tourist documents relating to this service , that will bring the amount paid for the ser- uncle and can not in any way be regarded tour operator.
B) CONDITIONS OF CONTRACT
These contracts are also subject to the following clauses of the general conditions of contract for the sale of packets the above mentioned tourist : art. 6 , art. 7 , art. 13 , art. 18.
The application of these clauses do not determine the configuration of related services such as the present case of package tour. The terms used in said clauses regarding contract for tourist package ( orga- absorber, travel, etc.) Can be understood with reference to the corresponding figures of the contract of sale of individual tourist services ( seller, accommodation etc.).

REPLACEMENTS

The transferor and the transferee are jointly and severally liable for the payment of the balance due and the amounts referred to in subparagraph d) of this Article.
WITHDRAWAL OF THE TOURISTS
The tourist who withdraws from the contract before departure, for reasons outside those listed by the relevant article of the General Conditions , will be charged the following cancellation charges:
50% of the price of the package up to 30 days before departure;
75 % of the price of the package from 29 to 7 days prior to departure;
100% of the price of the package after such terms.
Booking fee and entrance tickets pre-purchased for archaeological sites and museums are not refundable.
Penalty in case of partial or total withdrawal of the contract (school trips):
For journeys by bus and only for ground service = no penalty if the withdrawal does not cause a decrease in the number of paying the minimum required by preventive and above ( item No. pupils) . Otherwise the variable costs will be recalculated and will be informed of the amount of the penalty to be applied.
Booking fee and entrance tickets pre-purchased for archaeological sites and museums are not refundable.
For just the cost of the boat share = 50 % penalty up to 16 days. before the date of departure , no refund after this date , except as may be required by paragraph 14 of the ” Outline of Terms of Reference between travel agencies and educational institutions .” The contract is also governed by CCV ratified
In case of cancellation, for reasons not attributable to the organizer of a tour package constructed in accordance with the specifications and the contractor’s personal information ( customized trip ), they will be required to reimburse any costs incurred in the performance of ‘ assignment.
The contract shall be governed by the general conditions and technical details that are part of the same, as well as the travel schedule, any attachments, brochures, pamphlets and other documents explaining what you want the package tour so far provided and in compliance with the “Outline of Specifications of expenses between travel agencies and educational institutions” (note Ministerial. deIl’11 .4.2002 645, as amended, and in particular the final version passed by the 2011212002 1902 note).
PARAMETERS AND CRITERIA FOR THE ADAPTATION OF THE TRAVEL PRICE
The prices and changes in the course of validity, listed in the catalog or in the subsequent changes in the price list, are always expressed in euro and have been calculated on the basis of exchange rates, fuel costs and carbon tax estimated at the date of determination of price valid.
For this reason, the purchase price of the package might be a difference on the upside, as described below, if after the signing of the contract is a change in the parameters described below.
Raising cost auto fuels in transport mode or coach hire with driver , highway tolls cost variation , variation in costs and ingresi train tickets to the archaeological sites and museums that occurred successivamnte the signing of the contract (amounts verifiable from the bodies ticket issuance).
In the event of a change in the purchase price of the package more than 10% the consumer will be entitled to withdraw from the contract without penalty.
Administrative expenditure review/change adaptation practice: equal to 0 € for practice.
